These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.

“We” or “us” mean Elliott Opticians. “You” means the user of this website or the customer. “Irish” means the Republic of Ireland. Terms include these terms and conditions and any other terms that are set out in writing and agreed between you and us.
The following are the terms and conditions on which we enter a contract with you. These are intended to be fair to all parties and lay out our role as the optical provider to you. They set out your consumer rights and our responsibilities however, these conditions do not affect your statutory rights.
We suggest you keep a copy of these terms for your personal reference. A contract is only formed once we confirm shipment of the order to you. Please note that no products will be shipped unless we have received the amount due to us in full.
By choosing to buy from us, you agree to be bound by the terms on the site, including our returns policy.
PRIVACY
All the information collected on our site is for internal use only. We do not share your information with any third parties, excepting the address and phone number and delivery instructions, with our courier and postal partners to facilitate a smooth delivery of your package.
The information we collect may include your name, title, e-mail, phone number and address and prescription details. We may use the information provided by you to provide information about products, services and discount offers. You may choose to opt out of this service, if you so prefer.
In addition to this, we may collection information based on visits on our site. This would include the browser you use, the date and time the site it accessed, the pages accessed while on the site and the website from which an individual in linked directly to our site. This information helps us make your experience better.
Postal / Courier Delivery
We normally delivered all goods within the time frame we have agreed to, however, for that rare occasion when your package does not arrive, we cannot accept responsibility for the inconvenience and distress caused. We have partnered with reputable courier services but human errors occur and we apologise for the loss or inconvenience of a delayed package. We do thank you for your understanding in these circumstances.
Should a package be returned to us, we will contact you at the earliest opportunity to inform you of the situation. Please note, re-sending the item may incur an extra charge of which you will be advised.
GUARANTEE
If there is any mistake in the prescription of contact lenses by any party, we will supply the correct prescription.
Our guarantee on Progressive Lenses applies for 90 days from the date of purchase. We will replace them with single vision alternatives.
All our spectacles are covered by our 12 months guarantee against any frame manufacturing defect. In the unlikely event that this should be the case we will either repair or replace at our expense.
RETURNS/ EXCHANGES
As the items you have requested to buy are customised for you, we are unable to offer a full return or exchange in respect of every complete spectacle purchase. Our desire is that you will be happy with your purchase and once you alert us that you not entirely happy, we will contact you to rectify the matter to your satisfaction.
Should you have bought an item that did not need to be customised for yourself, you can choose to return it to us for its full value within 30 days of receiving it. The item needs to be in resaleable condition. For safety reasons we are unable to take returns of any contact lenses Please contact us so we can process the return or exchange. Please note that if applicable, the shipping cost will not be refunded.
ITEM DESCRIPTIONS
Descriptions given online are true to our knowledge. Please read the details, the reviews before deciding to make the decision. All images are provided to provide a guideline of the item. Our prices include all relevant taxes for Ireland and all our transactions are processed in Euros.
We reserve the right to correct the price, images or any other information provided on the site, without any liability on our part and without any.
BUYING ON OUR SITE
We offer you a fully encrypted site so you can shop on our site with ease. We do not keep a copy of your credit card details in our records and only the bank has access to those details.
We display items we have in stock. This gives you the option to Reserve the Item to come and try it in store, if you so choose. We reserve the right to change the products offered on the Website at any time without notice and to limit the number of items that may be purchased by a visitor. If we are unable to deliver an order placed by you, we will contact you at the earliest possible opportunity.
We assure you all the items delivered from our practices will be free of any defects or faults. However, if you are unhappy with the item, please contact us immediately and we will attempt to facilitate your request at the earliest convenience.
Please do note that orders must be placed by someone who is over 18 years of age.
LIABILITY
We are only liable to you for damage caused intentionally or by gross negligence. We will not be liable to you for any inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods or their delivery and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer.
SEVERABILITY
If one of the provisions of these General Terms and Conditions is or becomes invalid or unenforceable, that will not affect the effect of the other provisions.
JURISDICTION
These terms are liable to be changed anytime, as deemed necessary by us. The terms and conditions applicable to any customer are the terms for when an order was placed.
The contract formed between us and you will be governed under Irish laws and the customer agrees to submit to the non-exclusive jurisdiction of the Irish courts.
